These Terms of Service constitute a legally binding agreement between you and GoJourny LLC ("the Company," "we," "us," or "our"). By accessing or using StoryWonder ("the Service"), you agree to be bound by these Terms. If you do not agree to these terms, please do not use the Service.

2. Eligibility

You must be at least 18 years old to create an account and use StoryWonder. The Service is designed for parents, guardians, and educators to create storybooks with and for children.

Parental Supervision: We expect that children using the Service do so under the continuous supervision of a parent or guardian. By allowing a child to use the Service, you represent that you have the legal authority to agree to these terms on their behalf and you accept full responsibility for their activities.

3. Account Registration

To access certain features, you must create an account. You agree to provide accurate information and maintain the security of your credentials. You accept responsibility for all activities that occur under your account. GoJourny LLC reserves the right to suspend or terminate accounts that violate these terms.

4. User Content & Ownership

Your Story Content: You retain ownership of the original story text and narratives you create. By using the Service, you grant GoJourny LLC a non-exclusive, worldwide, royalty-free license to use, display, and reproduce your content for the purpose of operating and improving the Service.

AI-Generated Illustrations: Illustrations generated by the AI system are owned by GoJourny LLC. We grant you a perpetual, non-exclusive, personal license to use these illustrations within storybooks created on our platform. You may not sell, redistribute, or use these illustrations for independent commercial purposes outside of the StoryWonder platform without explicit written permission from GoJourny LLC.

5. Payments and Commercial Transactions

All purchases, subscriptions, and commercial transactions made through the Service are processed by GoJourny LLC. By making a purchase, you acknowledge that your financial contract is solely with GoJourny LLC. Charges on your billing statement will appear as STORYWONDER GOJOURNY.

6. Community Guidelines

When sharing content in the Story Library, you agree to share only age-appropriate content. GoJourny LLC reserves the right to moderate and remove content that is harmful, offensive, or violates these guidelines.

7. AI-Generated Content

StoryWonder uses artificial intelligence to assist with story development. You acknowledge that AI-generated content may not be perfect and is processed by third-party providers. GoJourny LLC strives for child safety but encourages parental review of all generated content.

8. DMCA and Intellectual Property Policy

If you believe that any content on the Service infringes upon your copyright, please notify our designated agent at info@storywonder.ai. GoJourny LLC adheres to the safe harbor provisions of the Digital Millennium Copyright Act (DMCA).

9. Limitation of Liability and Disclaimers

Service Provided "As Is": THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GOJOURNY LLC DOES NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ARE NOT RESPONSIBLE FOR ANY CONTENT CREATED BY USERS OR GENERATED BY AI SYSTEMS.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOJOURNY LLC, ITS MEMBERS, MANAGERS, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNT PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the Service shall be resolved in the state or federal courts located in Delaware.

11. Changes to Terms

We may update these Terms from time to time. Your continued use of the Service after changes become effective constitutes your acceptance of the revised terms.
